In a very recent and groundbreaking decision, the Pa. Supreme Court has held that, because employees are required to provide personal data (DOB, SS#, etc.), employers have a legal duty to protect that data from being compromised, even as the result of criminal conduct by third party hackers. We will discuss this case and recommendations for how employers can reduce their exposure to this risk of liability.
