U.S. Department of Labor Issues New “Streamlined” FMLA Optional-Use Forms

On July 16, 2020, the United States Department of Labor (U.S. DOL) announced that it was publishing new “streamlined” optional-use forms for workers and employers to use to coordinate Family and Medical Leave Act (“FMLA”) leave. U.S. DOL represents that the new forms are easier and more efficient for employers and employees to use.

The updated forms can be found here. These forms are recommended by the U.S. DOL, but are not required. However, by using these forms, employers have more certainty regarding whether they are in compliance with the requirements of FMLA. U.S. DOL also published a Request for Information in the Federal Register seeking the public’s feedback on FMLA generally.
