IMMIGRATION UPDATE CLIENT ALERT – FORM I-9 IS REVISED

U.S. IMMIGRATION AND CITZENSHIP SERVICES (“USCIS”) announced August 1, 2023, that Form I-9 Employment Eligibility Verification has been revised. According to the USCIS announcement, after October 31, 2023, the prior I-9 version will be obsolete and no longer valid for use. Accordingly, beginning November 1, 2023, employers who fail to use the new 08/01/23 edition of Form I-9 may be subject to all applicable penalties as may be enforced by U.S. Immigration and Customs Enforcement.

While employers using the prior I-9 version on and after November 1st may be able to avail themselves of various defenses to minimize or avoid monetary penalties, we strongly advise employers to immediately begin using the 08/01/23 edition of Form 1-9. Here is a link to the new Form 1-9:
