The Pennsylvania Department of Environmental Protection (DEP) is initiating remediation of this Lancaster County site. Berkley Products was operated in the 1980s and 1990s, accepting solvents and other waste materials from a variety of businesses in Central Pennsylvania and Maryland. The DEP has proposed a clean up plan to meet state standards for soil and groundwater remediation on this property and on neighboring properties around the facility. All businesses that sent waste to this site should have received a letter from DEP indicating they are a "Potentially Responsible Party" (PRP) at the Berkley Products site. DEP has used invoice and manifest documents to identify the PRP businesses and persons. DEP can seek reimbursement of its remediation costs from the PRPs. The state estimates the costs for remediation will be between $2-$3 million.
Stock and Leader is assisting PRP entities in resolving the varying levels of potential liability with the DEP. We anticipate that DEP will extend settlement offers to smaller contributors at the site in the next few months.
